President Obama and his minions are fond of saying, "The ACA is the 'law of the land,'" and invoking such admonitions as "We are a nation of laws." But when John Adams coined the phrase "Rule of Law," he was referring to the basic precepts of the Republic – what was to become the Constitution of the United States. He was not referring to haphazard and slipshod politically motivated legislation.
The framers of our Constitution, while giving prime importance to the legislative branch, recognized the human propensity for stupidity. And they decreed a Supreme Court to rein in the inevitable overzealousness of elected officials who have never read the Constitution and are only peripherally aware that a Constitution exists.
They also, in Article 10 of the Bill of Rights, ratified as an integral part of the original Constitution by the States in 1791, granted the People the right to decide for themselves whether federal legislation conformed to the law and to act accordingly.
The law is the set of rules that guides us in every public endeavor, that defines the legality of government actions and government legislation, and that protect us from government overreach. In other words, the law is the Constitution.
Legislation is an exercise in self-veneration. Legislators imagine that they are the purveyors of national morality and propriety – that without their direction the peasants would not know how to act. They actually believe that they can curtail crime by passing legislation making it illegal!
It's already illegal, dummy! If I am bent on murdering someone, I will not be deterred by something printed on 24# bond by a bunch of ivory tower megalomaniacs in Washington Den o' Crooks! I will be deterred only by the knowledge that the law protects us all – not because it was imposed on us – but because we mutually agreed to it.
America was once a nation of laws. It has become a nation of men – and very unsavory men (and women) at that! It is up to us – We The People – to right our country. Look not to Washington for help. That is the source of our malady. Look inside yourself – and find the moral fiber that strengthened and empowered the men who braved death to found this Republic for us. Let us not allow it to die!
