The Helms-Burton Act, signed into law by President Clinton on 12 March 1996, prohibits US recognition of any Cuban government that includes Fidel or Raul Castro and provides the Legislative Branch with the power to override any Executive Branch cancellation of the US embargo on trade with Cuba.
The Helms-Burton Act is still in force. It has not been repealed. It is the law of the United States of America.
Yesterday, Barack Obama, President and Criminal-in-Chief of the United States, announced that he is restoring full diplomatic relations with Raul Castro's Cuban government and will be opening a US embassy in Havana. When did the President of the United States acquire the authority to overturn Acts of Congress at his whim?
This is a clearly illegal and certainly impeachable act on the part of the President. Why is he doing this? And why now? He's doing it because he hopes he can get it through while Harry Reid is still in dictatorial control of the US Senate.
This is another example of lame duck politics, embellished with the subterfuge of dumping this illegal and un-Constitutional decision on the American People one week before Christmas. He hopes that, with everyone distracted by the holidays, he can slip this one by us without anyone noticing.
The President has tried and will try to disguise his illegality with the cloak of humanitarianism. But in the final analysis it makes no difference if his actions help the Cuban people. It would make no difference if his actions made every Cuban man, woman, and child a billionaire. The law is the law.
And the law must be obeyed – particularly by those who have taken an oath to obey and enforce it!
Mr. Obama will probably – and hopefully – fail in this attempt to thwart the will of Congress and the People of the United States. He could even be removed from office for this blatant crime against the American People. But, although Mr. Obama is a hardened criminal, he is not the root problem.
The real problem is our allowing lame duck Presidents and Legislators to continue to preside and legislate after the People have voted them out of office.
And that is a problem we need to rectify.
